Trooper's Narrative (edited due to length)

On Friday March 22nd, 2024, I, Trooper Adrienne Belcher, was merging onto Interstate 40 eastbound at the 84 eastbound
on ramp. I observed a dark colored sedan drive over the fog line onto the south shoulder of the roadway. I accelerated my
speed to catch up to the vehicle. As I was approaching the vehicle, I observed the vehicle drive over the fog line again. I
initiated my blue lights to stop the vehicle at the 84.5 mile marker eastbound. The vehicle, a gray Honda Accord with a
temporary tag, continued driving in the outside eastbound lane, and crossed the white dotted center line. I initiated my siren to
get the attention of the driver. The driver still did not acknowledge that they recognized that I was behind them. I attempted to
get even closer to the vehicle, and he tapped his brakes indicating that he acknowledged that I was behind him. The driver put
his blinker on and moved to the south shoulder of the roadway at the 85.5 mile marker. Once he pulled to a stop, the temporary
license plate became visible displaying temporary tag, DA981745. I advised Clarksville of the tag before exiting my unit.
Clarksville advised that it returned to a 2009 Gray Honda Accord.

As I was exiting my unit, the driver opened his door. I immediately told him to shut the door. The driver shut his door after I told
him twice to close the door. I walked behind my unit to the passenger side to make a passenger side approach. I stopped at my
passenger side to retrieve my hat which had fallen into the floorboard while stopping. As I was about to close my passenger
door, the driver put his vehicle in drive and took off. I shut my passenger door and ran back to my driver’s seat. As my lights
were already activated, I initiated my siren and advised Clarksville that I was in pursuit. There was a vehicle in the right lane
ahead of the suspect vehicle. The suspect vehicle drove up behind the other vehicle not noticing it at first. The suspect vehicle
braked hard and maneuvered left avoiding the other vehicle and making an unsafe lane change. The suspect vehicle came
back into the right lane side swiping the other vehicle. The suspect's reckless driving caused the suspect to lose control of his
vehicle. The suspect vehicle went off the roadway to the right down the embankment into the trees at the 86.2 mile marker.

I placed the driver, identified as Jerod Kell, into handcuffs and double locked the cuffs. I could smell the odor of intoxicants
emitting from Kell’s person as I was walking him to my unit. As Kell was being walked up to my unit, he became agitated and
started cussing. Kell was searched by a male officer on scene and placed into the back of my unit. I went back down to Kell's
vehicle to look inside. I observed an open beer can of Milwaukee Best Ice in the center cup holder. Trooper Bird arrived on
scene, waited for the wrecker and worked the accident report. I transported Kell to the Pope County Detention Center to
perform Field Sobriety on him and to do a BAC test of his breath.

Kell took the BAC with a result of NA and to retest because the
results were not within .020 of each other on the two breath samples. I reentered everything and began a second BAC test. Kell
blew two good samples with a BAC result of .27. I read Kell the part on the Statement of Rights form about an additional test at
his own expense, and Kell stated that insurance would cover it and he wanted one.

I transported Kell back to the Pope County Detention Center where he was released into the custody of correctional officers.
Once they put Kell into a cell, Kell began screaming and acting out of control. I filled out the Felony hold form for Pope County
with the charges Fleeing by vehicle or conveyance 5-54-125, DWI 1st 5-65-103, Drinking on the Highway 5-71-212 (c), Open
Container Containing Alcohol in Vehicle5-71-218 , Driving left of Center27-51-301(a) , Careless or Prohibited Driving 27-51-104
, Reckless Driving 27-50-302(a)(2) , Unsafe lane Change 27-51-104 (b), and Failure to Maintain Control 27-51-104 (b)(6).
