Personal appearance, satisfactory identification, and valid certificates are at the core of every notarization — and they play a major part in most Notary lawsuits. Notary liability occurs when damages are caused by improper notarizations, negligence, simple errors, and even innocent mistakes. Anyone involved in a transaction that requires notarization can file a lawsuit, forcing Notaries into a courtroom to prove their innocence or face the music and pay up.
