The federal opposition is accusing the government of being "missing in action" after an elderly Perth woman was allegedly attacked in a violent home invasion by an immigration detainee released after the NZYQ High Court ruling.
Majid Jamshidi Doukoshkan, 43, was one of several charged over an alleged home invasion and burglary in which 73-year-old Ninette Simons and her husband were attacked.
Ms Simons was allegedly struck unconscious and was later hospitalised with head injuries, while her husband was tied up and assaulted.
Opposition Leader Peter Dutton said there was no clarity on how Mr Doukoshkan allegedly breached curfew, whether he was being monitored or whether any attempt had been made to re-detain him, under sweeping powers the government granted itself in legislation rushed through parliament.
